So I have been told by a couple of lawyers that if I file bankrupt before my show cause hearing for a judgement/wage garnishment for a car I sent back, that I still have to go to court, because if I don’t, the court can issue an arrest warrant, but that the judge can not find me in contempt for this judgement because the automatic stay protects me in the bankrupt. Is this true?
This is one of those tough questions that really cannot be answered in a forum like this because there are too many variables. You should come talk to us or another experienced bankruptcy attorney right away. Bankruptcy can certainly make the debt go away and there is other action that we can take that may help.
