Once this decision had been made, I wanted to help them file as quickly as possible because they had a general sense of despair created by their overwhelming debt. Unfortunately, the husband’s health was poor and would prevent him from being able to meet with me. I was glad to work around that problem by preparing a special power of attorney, which granted the wife the power to sign for her husband.
This was a particularly rewarding case because of the couple’s circumstances. They are retired and Social Security is their only income. Filing the Chapter 13 gave them an immediate sense of relief, and I was glad I was able to help make that happen.
