Bankruptcy and Federal Tax Liens

I met with an older couple more than a year ago when they first came to talk with me about bankruptcy.  As we worked through their situation, they decided against bankruptcy because of worries about a federal tax lien.

Over the following year their stress got worse as they were threatened with several lawsuits.  So they called for another meeting and we sat down again this March.

After talking about the pros and cons of bankruptcy, this couple decided to proceed with a Chapter 13 filing.  Once this decision had been made, I wanted to help them file as quickly as possible because they had a general sense of despair created by their overwhelming debt.  Unfortunately, the husband’s health was poor and would prevent him from being able to meet with me.   I was glad to work around that problem by preparing a special power of attorney, which granted the wife the power to sign for her husband.

This was a particularly rewarding case because of the couple’s circumstances.  They are retired and Social Security is their only income.  Filing the Chapter 13 gave them an immediate sense of relief, and I was glad I was able to help make that happen.
