Common Law Marriage Spouse Death, With No Will

My girlfriend and I have been together for 6 or 7 years she was disabled and she passed away 3 days ago. What legal rights do I have? Am I entitled to anything such as money? I’ve been taking care of her for 7 years of my life, helping her in every aspect of her life. Am I entitled to anything?

Since you did not mention a will, I will assume that your girlfriend died without a will. Unfortunately, Arkansas does not recognize common law marriage. If your girlfriend did not have a will, then the law states who will inherit and it is very specific. All of the heirs who are listed in the intestate succession are relatives. Your girlfriend’s estate will have to go through probate. If her family is aware of her relationship with you it is possible that they may be willing to voluntarily establish some sort of a gift for your benefit. I urge you to consult with an experienced probate attorney in your area.
